On 12 January 2023, MIPD Announced an update about attending the representative training.
Trademark Law (2019) is being implemented to come into force in March 2023, and after coming into enforce, the trademark registration application will be officially accepted including payment. After coming into enforce, those who have obtained a WIPO FILE User Account will be allowed to act as representatives of trademark registration only after attending trademark registration representative training opened by Myanmar’s IP Department.
The new Trademark Law 2019 was enacted on January 30th, 2019. On August 28th, 2020, the Ministry of Commerce announced Order No. 63/2020 allows the refiling of trademarks that have been registered with the Registration of Deed Office or are being used in Myanmar. The soft opening period began on October 1st, 2020. According to Order No. 63/2020, it is considered that there are two steps of the Soft Opening and the registered/used trademarks that want to enjoy the New Trademark Law need to refile during the soft opening period.
The first step of the Soft opening – We are now during the first step of soft opening and only registered/ used marks are eligible for refiling. All complete Trademark applications and prescribed official fees during the first step of the soft opening will be given on the first day of the Grand opening. The official fee is unavailable during the first step of the soft opening.
The second step of the Soft opening – This step should be considered part of the soft opening period. But in this step, the payment of the official fee will be available. Like the first step, only registered/ used marks are eligible for filing during this step, and all completed Trademark applications and prescribed official fees during this step will be given the first filing date of the Grand opening as well.
The grand opening of the new trademark registration system will take effect in April 2023. During the grand opening, the New trademark will be eligible for filing under the New Trademark Law. The date of the filing will be on which MIPD receives the complete application and prescribed official fee.
Appointment of representative (TM-2 form)- On 1st July 2022, the Ministry of Commerce issued Notification No.44/2022 to prescribe official forms including the TM-2 form for the appointment of the representative(s). Each TM-2 form needs to be notarized but does not need to be legalized.
