The State Administration Council of Myanmar has issued notification No. 82/2023 announcing the effective date of the Trademark Law as April 1, 2023. The information was shared by Myanmar’s Intellectual Property Department (MIPD) during a discussion panel held on March 9, 2023.

According to MIPD, the second phase of the “Soft opening period” will commence on April 3, 2023, and will continue until the official announcement of the “Grand Opening Date” in 2023. The official fees and necessary rules are expected to be issued in April 2023.

During Phase-2, only “Old Trademarks” will be eligible for registration. These are trademarks that:

Registered at the Office of the Registrar of Deed and Assurances, or

Old Trademarks in Myanmar Market before April 1, 2023.

For the registration of Old International Trademarks, applicants must submit the notarized appointment of representative form (TM-2) together with their application. The “Filing Date” of a trademark application that was filed during Phase-1 and Phase-2 will be set as the “Day-1 of Grand Opening” subject to the completion of the application and payment of required fees.

After the successful conclusion of Phase-2, Phase-3, the grand-opening of trademark registration, will commence. MIPD anticipates that the duration of the period between Phase-2 and Phase-3 will be “30 days”. During Phase-3, MIPD will start accepting the registration of new trademarks. Old trademarks can also be continued to register for a certain period of time, as set by MIPD.

Finally, MIPD will announce the commencement of the final phase (Phase-4), during which only new trademarks can be applied for registration.
